Talk: The Intricate Relationship between Trademark Licensing and Non-Traditional Trademarks
During the last decades, registrations of non-traditional trademarks have become common in most countries. However, many of these registrations have been later cancelled, challenged, or reduced in scope.
In this presentation, Professor Calboli addresses the topic of non-traditional trademarks from the point of view of trademark licensing. In particular, she will highlight the unique challenges that such marks pose for trademark licensing and the requirement of quality control. Since non-traditional trademarks often concern aesthetic features which are functional at the same time, is compulsory licensing relevant? If yes, should it be introduced in international trademark law.
