3-D TRADE MARKS & DESIGN RIGHTS – A comparative analysis between Europe and Asia

The panellists, individuals who have been involved in the Nestlé’s 3D mark case, will discuss developments in the field of 3D trademark law, particularly, Nestlé’s four finger chocolate bar. The discussion will revolve around:

  1. the EU’s General Court decision on December 15, 2016 on the validity of Nestlé’s EU trademark no. 2632529;
  2. the Court of Appeal of England and Wales judgment on May 17, 2017; and
  3. the Court of Appeal’s judgment on 24 Nov 2016.

There will also be a discussion on survey evidence in such cases.


Arthur Yap
Arthur was conferred a degree in Chemical Engineering with First Class Honours in 2003 from the National University of Singapore and in 2006, he was also conferred a degree in law with Second Class Honours (Upper Division). Armed with a strong technical background and combined with his legal knowledge, Arthur’s strength lies in his ability to quickly appreciate technical issues and provide decisive practical commercial solutions for his clients. His practice focuses primarily on contentious IP work as well as commercial disputes with significant experience before the High Court and Court of Appeal as well as SIAC administered arbitrations.

Henning Hartwig
Henning Hartwig’s practice involves prosecution and litigation of IP rights in the fields of trademark, design, copyright and unfair competition law. Recently, before the German Federal Court of Justice, Henning Hartwig was successful in defending a global chocolate manufacturer against claims asserted for injunctive relief and damages on account of alleged 3D trademark infringement and unfair competition.

George Hwang – Moderator
George is the current President of LES Singapore. His practice centres around IP and Media. George was part of the team which successful overturned the High Court’s decision at the Court of Appeal in protecting the confidentiality of a journalist’s sources. He recently argued Singapore’s first case on passing-off and image rights. The matter is now pending for the court’s judgment.
